The Prime Minister has appointed Jonathan West to “to define priorities for Tasmania,” to allocate $100 million regional development funds under the forest peace deal


So just who is Jonathan West in 2013

The Mercury described him “as former Harvard professor Jonathan West, who recently painted a damning picture of the state's welfare mentality in an essay for the Griffith Review.”


Yet his involvement with the Greens war against the State’s forest industry has a long and intertwined history.


In 2011 the Prime Minister appointed to him to chair and conduct the "independent verification” on the claims of the wilderness society and other environmental non government organisations on high conservation value forests.

The team of Independent experts Jonathan West assembled.

Professor West assembled a team of independent experts including Wilderness Society Wild Country Science council member Brendan Mackey, former consultant to the Wilderness society on world Heritage issues, Peter Hitchcock, and former National forest coordinator of the Wilderness society, Sean Cadman. Despite the expenditure of substantial funds the panel was not able to offer a solution. It was not until April 2013 that Parliament agreed to legislate a peace deal. Professor West had been recruited to provide advice by ormer ACTU secretary Bill Kelty who facilitated the process that led to the Prime minister and Premier signing the August 2011 Intergovernmental Agreement


In promising an independent and robust process Dr Jonathan West, was described as founder (in 2007), Professor of Innovation and Director, Australian Innovation Research Centre.


He returned to Australia to take up the University of Tasmania role after 18 years at Harvard University, he also undertook his doctorate and masters degrees and where he was also Associate Professor in the Graduate School of Business Administration.

 

Dr Jonathan West's Part in The Federal Intervention

 
Yet before that in 1987 he was the National Director of the Wilderness Society, instrumental in setting up the Helsham inquiry into the Southern and Lemonthyme forests, the first time the Commonwealth had acted to override State land use powers in relation to forest management. Like the current peace deal the Federal Labor government created massive forest reserves and nominated a major extension to the Tasmanian wilderness World heritage Area.


Before his appointment as National director of the Wilderness Society he was a political adviser to Barry Cohen, the ALP’s first Federal Environment minister who recruited West doe to his effectiveness as a lobbyist with the ACF and wilderness society.

There are many that think the past Independent Verification Process that was chaired by Professor Jonathan West and the Intergovernmental Forest Agreement has also been stage managed by Markets of Change, the Federal Greens, Australian Federal labour party, Tasmanian Greens and the State Labour Party as the arranged agreement when the then Green Labour Alliance was formed that we have had over the last few years after the 2010 election.

 

The present Tasmania premier has says she would do it again. What would the next aggreement be? Which industry would go next time, mining?

What does the do? The Heads of Government Agreement between the Prime Minister and Premier of Tasmania includes an Independent Verification Process:.

"Clause 2 430,000 hectares of nominated native forest, from within the 572,000 hectares nominated by the Environmental NGOs, through the signatories, will be placed in immediate informal reserve by the state, subject to an independent verification process led by Professor Jonathan West.

Verification of the boundaries of these 430,000 hectares will take place as soon as possible. This interim forest area will be protected from logging while the verification process is completed, subject to the agreed requirements of existing contracts, consistent with the Kelty process.

 

This verification process will verify the boundaries and conservation value of the nominated areas and the level of reserve from the nominated 572 000 hectares compatible with the guaranteed supply outlined above. The process will be conducted by a body independent of both Governments and all other stakeholders and resourced by the Australian Government.

 

The process will be led by Professor Jonathan West and a group of experts jointly nominated by the Australian and Tasmanian governments. The group will use its best endeavours to report to the Prime Minister and Premier by the end of 2011.

 

The verification process will include opportunities for stakeholders and community members to contribute to and review the modelling of options and outcomes as far as possible. These findings will determine the area of HCV forest to be reserved. The Australian Government will provide funding for the verification process."

Page 90 At Jackeys Marsh protest in 1986: As told by Sean Cadman (currently a consultant to the ENGOs engaged in the Kelty process) and Rosemary Norwood,

"...the director of the Wilderness Society at the time was a personal friend."

"It started to look as if we were going to lose it again at which point Bob Brown came in, and Jonathan West, who was then the Director of the Wilderness Society, and they said 'There's only one thing that going to save this, and that's if everyone in the valley is arrested.'"

Industry only stays afloat because the money comes out of the taxpayers pocket to keep it afloat. There is a profit being made in wood chipping, but it is only being made because taxpayers are subsidising the industry. It is difficult for the public to get access to information; there are industry secrets, and business secrets to favour contractual and trading arrangements." Jonathan West, then director of TWS, asked me to come in and help; we really needed a flag – waving campaign and this was to be the unseating of Michael Hodgman MHR in the Denison electorate. The badges... 'I paid $1 to get rid of Michael Hodgman.'

The last line on this page, written by a Jill McCulloch is "Once an activist, always an activist."

As National Director from December 1986 until he resigned in September 1987, to take up post graduate studies at the Harvard Business School, (as reported by the Advocate 29 Sep 87), Jonathon West issued letters seeking campaign funds and oversaw the publication of the Wilderness News. These publications include advocating for the reservation of Tasmania's native forests.

The Umpire not just needs to be independent but must appear independent

 

Apprehension of Bias. The greens asked for Independence with Dr Raverty.

At the first direction hearings of the Resource Planning and Development Commission in 2006, as part of the assessment of a pulp mill, the Greens political party demanded that Dr Warwick Raverty disqualify himself from the panel.

The basis for that application was that "…in all of the circumstances, the parties or the public might entertain a reasonable apprehension that Dr Raverty might not bring an impartial and unprejudiced mind to the resolution of the matter …" (i.e., a "reasonable apprehension of bias")

Dr Raverty was an employee of Ensis. Ensis was a joint venture of the CSIRO who had commented upon the proposed pulp mill guidelines. Similarly a person, who worked as a Director of the Wilderness Society and was involved in a number of campaigns over a number of years including giving advice on protesting, issuing public statements, lobbying politicians and advocating for the reservation of forests based upon their conservation value, may be perceived by the public to not be "independent".

The greens also argued that the rules of natural justice require that the decision maker must bring a fair and unprejudiced mind to the determination of the issue before him. Ask yourself. Does Dr Jonathan West do this?

 

Federal government awareness

The Weekend Australian revealed on 19 February 2011 that Mr Kelty, appointed by the Gillard government as independent facilitator to assist negotiations between conservationists and loggers, enlisted the advice of veteran environmentalist Alec Marr. "As well, the former ACTU secretary has sounded out former Harvard professor Jonathan West..."

Given the relationship of Jonathan West to Craig Emerson, currently the Minister for Trade in the Gillard cabinet, it would seem inconceivable that the Governments would not have been aware of Jonathan West's involvement in the massive forest lock ups and other activities in the 1980's that started the 30 year conflict.

 

The Questions everyone will be asking

Why did? Heads of Government Agreement, the Kelty process or the proposed Intergovernmental Agreement survive the Government appointment of this former National Director of the Wilderness Society as the independent umpire?

Has it place at risk the proposed 'guaranteed' wood supply of High quality sawlogs, peeler billets and Special Timbers?

Has the assessment of High Conservation Values be credible?

Has Stakeholders and community members receive 'natural justice' when making submissions?

Can the process or the Government response enjoy electoral support?

 


Do you think that Jonathan West Was Independent?

 

Do you think that the whole process was a Setup or Stage Managed

 

Was he impartal?

 

Was he unbiased?

 

If you have any doubts about his impartiality then he his not INDEPENDENT.

 

If the Governments thinks this system is INDEPENDENT then could we trust any thing that this GREEN, LABOUR GOVERNMENT has done?

Abandoned Camp Upper Florentine
